Senate Finance Committee Chairman Max Baucus is the first Democrat to express displeasure with President Obama's recess appointment of Dr. Donald Berwick to head the agency overseeing Medicare and Medicaid.Yeah, because Bush never made any, and Clinton, and Bush Sr, and Reagan, oh wait they all did. Obama's still made the fewest number of them. I understand old Maxie thought he wasn't getting enough attention in the press sticking a knife in Obama's back since the health care debate, I guess he was bored. That means Joe F'ckin Lieberman is about due too.
"I'm troubled that, rather than going through the standard nomination process, Dr. Berwick was recess appointed. Senate confirmation of presidential appointees is an essential process prescribed by the Constitution that serves as a check on executive power and protects Montanans and all Americans by ensuring that crucial questions are asked of the nominee – and answered," the Montana senator said in a statement.

The argument further maintains that recess appointments were only to be made during intersession recesses, which during the early days of the country lasted between six and nine months, and were therefore required to prevent important offices from remaining unfilled for long periods
Regardless of President it's wrong. Especially for a Pres who ran on a platform of Hope and Change when in actuality it's more of the same.
But in the end it will be made right
To remain in effect a recess appointment must be approved by the Senate by the end of the next session of Congress

Pointing out that other Presidents have made recess appointments is not childish. It is fact. You have problems with those when you can't find a way to manipulate them into your "I'm a Republican partisan pretending to be a Libertarian" shtick.
Childish is bringing serial killers into the argument and then spouting nonsense like "fail harder".

Yes it is, because regardless of if someone else has done something doesn't make it right. Didn't your parents ever teach you two wrongs don't make a right? Hence my sarcasm. This is again further proof as to why you fail at arguing. The logic you chose to use rather than just noting that Article II, Section 2 of the U.S. Constitution states this is a pres power. Nobody is denying it's a pres power you tool. It's the way you went about presenting your argument that's fail. There is no need to defend a power granted by the constitution, this is a case of you feeling compelled to defend Obama.
Also using internet terminology like fail harder does not negate the points made.
